Thưa quý vị và các bạn, 

Thứ Sáu tuần qua tại Geneve Hội Đồng Nhân Quyền Liên Hiệp Quốc đã dành 4 giờ cho các phái đoàn của 75 quốc gia phát biểu về những vấn đề nhân quyền và vi phạm nhân quyền. Đặc biệt về Việt Nam đại diện phái đoàn nhân quyền Hoa Kỳ là người phát ngôn duy nhất đã yêu cầu chi1`nh phủ Hà Nội trả tự do cho Linh Mục Nguyễn Văn Lý và 2 Luật Sư Nguyễn Văn Đài và Lê Thị Công Nhân đã bị truy tố và kết án về tội giả tạo  tuyên truyền chống nhà nước. Sau đó phái đoàn Hoa Kỳ còn yêu cầu chính phủ Việt Nam hủy bỏ Điều 88 Hình Luật quy định tội trạng này.

Trong 30 năm, từ 1977 đến nay, Linh Mục Nguyễn Văn Lý đã bị bắt giữ và giam cầm tất cả 4 lần:

- Năm 1977 Cha bị chính quyền bắt giữ 4 tháng "vì có những hành vi tuyên truyền chống chế độ xã hội chủ nghĩa".

 

-  Từ 1983 đến 1992 Cha bị Tòa Thừa Thiên kết án và giam giữ 10 năm về tội "phá hoại chính sách đoàn kết quốc gia".

 

- Ngày 19-10-2001, hơn 1 tháng sau vụ Đại Khủng Bố 11 Tháng 9, Đảng Cộng Sản Việt Nam lợi dụng thời cơ leo thang khủng bố và đã xử phạt Cha 15 năm tù về 2 tội "phá hoại chính sách đoàn kết quốc gia" và "vi phạm quyết định quản chế hành chánh".

-   Và ngày (30-03-2007), Cha lại bị kết án 8 năm tù về tội "Tuyên Truyền chống Nhà Nước Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam".

 

6 tuần sau, ngày 11-05-2007 các Luật Sư Nguyễn Văn Đài

và Lê Thị Công Nhân đã bị kết án..... năm tù cũng về tội này.

 

Đây là những vụ đại hình nghiêm trọng về xâm phạm an ninh quốc gia mà hình phạt có thể đến 12 hay 20 năm tù. Vậy mà các bị cáo chỉ có một thời gian quá ngắn, (từ 5 tuần đến 10 tuần) để chuẩn bị sự biện hộ. Trong vụ Nguyễn Văn Đài và Lê Thị Công Nhân, bảng cáo trạng được thông tri cho các bị cáo ngày 3-5-2007. Và 8 ngày sau, ngày 11-5-2007 tòa bắt đầu xét xử. Đây là một sự tước đoạt trắng trợn quyền bào chữa của các bị cáo được có đủ thời gian và phương tiện liên lạc với luật sư để chuẩn bị sự biện hộ.

 

Lịch sử tư pháp Việt Nam cho biết, trong những vụ án chính trị, tòa án  thường tuyên những bản án tiền chế theo chỉ thị của Đảng Cộng Sản. 

 

Kể từ thập niên 1990, trong 6 bản án chính trị:

 

1) bản án ngày 29-11-1991 phạt Bác sĩ Nguyễn Đan Quế 20 năm tù về tội phản nghịch hay âm mưu lật đổ chính quyền nhân dân;

 

2) bản án ngày 19-10-2001 phạt Linh Mục Nguyễn Văn Lý 15 năm tù về các tội phá hoại chính sách đoàn kết quốc gia và vi phạm quyết định quản chế hành chánh;

 

3) bản án ngày 08-11-2002 phạt Luật Gia Lê Chí Quang 4 năm tù về tội tuyên truyền chống nhà nước;

 

4) bản án ngày 20-12-2002 phạt cựu chiến binh Nguyễn Khắc Toàn 12 năm tù về tội gián điệp;

 

5) bản án ngày 30-03-2007 phạt cha Lý 8 năm tù về tội tuyên truyền chống nhà nước, và 6) bản án ngày 11-05-2007 phạt hai Luật Sư Nguyễn Văn Đài và Lê Thị Công Nhân ........ năm tù cũng về tội này, có điểm tương đồng là tất cả 6 vụ án đều đã được xét xử  vắn tắt trong mấy tiếng đồng hồ vào ngày thứ sáu cuối tuần. Mục đích để làm giảm thiểu phản ứng bất lợi của giới truyền thông, và làm nhạt chú tâm của quần chúng trong những ngày cuối tuần.

           

Tuyên truyền chống chế độ hay tuyên truyền chống nhà nước không cấu thành tội hình sự . Vì tuyên truyền chỉ là việc hành sử quyền tự do tư tưởng và tự do phát biểu quan điểm. Cùng với quyền tự do lập hội và lập đảng, những quyền này đã được bảo vệ bởi các Điều 19 và 22 Công Ước Quốc Tế về những Quyền Dân Sự và Chính Trị, và bởi Điều 69 Hiến Pháp Việt Nam. Do đó các bản án phạt Cha Lý và hai Luật Sư chỉ vì có những hành vi tuyên truyền chống nhà nước và thành lập các chính đảng đối lập đã hiển nhiên vi phạm hiến pháp quốc gia và công ước quốc tế.

 

Về tội tuyên truyền chống chế độ, giữa thế kỷ 19, khi Các Mác công bố bản Tuyên Ngôân Cộng Sản kêu gọi vô sản toàn thế giới đứng lên dùng võ trang lật đổ chế độ tư bản, ông ta cũng không bị Tòa Án Luân Đôn truy tố về tội tuyên truyền chống chế độ tư bản chủ nghĩa. 

 

Sau cuộc Cách Mạng Dân Chủ 1989 tại Đông Âu, nhân loại văn minh đã vứt vào thùng rác lịch sử chế độ mệnh danh là xã hội chủ nghĩa. Cũng vì vậy Đảng CS Việt Nam đã giảo hoạt thay đổi tội danh, từ tuyên truyền chống chế độ (Điều 82 cũ) thành tuyên truyền chống nhà nước (Điều 88 mới).

 

Tuyên tuyền chống chế độ và tuyên truyền chống nhà nước là những tội danh giả tạo không tìm thấy trong các bộ hình luật của các quốc gia văn minh trên thế giới.

 

Chiếu Điều 15 Công Ước Quốc Tế về Những Quyền Dân Sự và Chính Trị "không ai có thể bị kết án về một tội hình sự do những điều mình đã làm, nếu những điều ấy không cấu thành tội hình sự chiếu luật pháp quốc gia hay luật pháp quốc tế, luật pháp quốc tế là những nguyên tắc luật pháp tổng quát được thừa nhận bởi cộng đồng các quốc gia" (cụ thể là những nguyên tắc và mục tiêu ghi trong Hiến Chương Liên Hiệp Quốc, Tuyên Ngôn Quốc Tế Nhân Quyền và các Công Ước Quốc Tế  do Liên Hiệp Quốc ban hành).

 

            Theo bản cáo trạng, các Luật Sư Nguyễn Văn Đài và Lê Thị Công Nhân bị truy tố về tội tuyên truyền chống Nhà Nước chiếu Điều 88 Khoản 1 Điểm (a) và (c) Hình Luật. Các Luật Sư bị trách cứ đã có những hành vi phỉ báng chính quyền và chống Nhà Nước bằng tuyên truyền xuyên tạc, tàng trữ và  phát hành các tài liệu có nội dung chống Nhà Nước.

 

            Điều 88 Khoản 1 Điểm (b) còn kết án tội "dùng chiến tranh tâm lý để tuyên truyền gây hoang mang trong nhân dân". Đây là một tội lỗi thời, tàn tích của thời chiến tranh lạnh. Người Cộng Sản thường lầm lẫn luật pháp với chính trị. Họ đã sáng chế ra những tội trạng giả tạo phi- pháp- lý như phản động, phản cách mạng, địa chủ, cường hào ác bá, xét lại chống đảng, biệt kích văn nghệ v...v... Đối với họ, chính trị là thống soái và luật pháp là công cu.ï Bộ Luật Hình Sự 1985 cũng xác nhận điều đó: "Trong hệ thống pháp luật của nước Cộng Hòa XHCNVN, luật hình sự là một công cụ sắc bén của Nhà Nước chuyên chính vô sản để bảo vệ chế độ xã hội chủ nghĩa, đấu tranh góp phần xây dựng thành công chủ nghĩa xã hội".

            Trong chiều hướng đó Quốc Hội Cộng Sản đã ban hành những đạo luật hình sự  quy định những tội trạng bịa đặt giả tạo và cưỡng ép lố bịch với những yếu tố cấu thành tội trạng hết sức bao quát và mơ hồ,  như các tội tuyên truyền chống chế độ, tuyên truyền chống nhà nước, lợi dụng quyền tự do dân chủ, phá hoại chính sách đoàn kết quốc gia, phá hoại chính sách đoàn kết quốc tế, gián điệp, hoạt động nhằm lật đổ chính quyền (phản nghịch ) v...v....

 

Việt Nam đã ký kết tham gia Công Ước Quốc Tế về Những Quyền Dân Sự và Chính Trị năm 1982, nên có nghĩa vụ pháp lý phải tôn trọng và thực thi những điều khoản ghi trong Công Ước này. Chiếu Điều 2 Công Ước, các quốc gia hội viên tham gia Công Ước này cam kết sẽ tôn trọng và bảo đảm thực thi những quyền tự do cơ bản đã được thừa nhận trong Công Ước cho tất cả mọi người sống trong lãnh thổ quốc gia. Trong trường hợp những quyền tự do ghi trong Công Ước này chưa được quy định thành văn trong luật pháp và hiến pháp quốc gia, các quốc gia hội viên ký kết hay tham gia Công Ước có nghĩa vụ phải ban hành các đạo luật bổ túc theo tinh thần và bản văn các điều khoản nhân quyền của Công Ước để các quyền này được thực sự thi hành.

 

Trong trường hợp các quốc gia hội viên kết ước không quy định thành văn những quyền này trong luật pháp hay hiến pháp thì những điều khoản về nhân quyền và về những quyền tự do cơ bản của người dân ghi trong Công Ước vẫn có hiệu lực chấp hành và phải được áp dụng trước các tòa án quốc gia và quốc tế.

 

Hơn nữa, chiếu Điều 5 Công Ước Dân Sự Chính Trị, các quốc gia hội viên kết ước không được giải thích xuyên tạc các điều khoản trong luật pháp quốc gia và công ước quốc tế để làm những hành vi nhằm phủ nhận và tước đoạt của người dân những quyền tự do cơ bản đã được thừa nhận trên toàn cầu.

 

Tuyên truyền không phải là một tội hình sự, dù là tuyên truyền chống chính phủ, chống chế độ hay chống nhà nước. Đây chỉ là việc hành sử quyền tự do tư tưởng, tự do phát biểu, quyền đối kháng, quyền tham gia chính quyền và quyền thay thế chính quyền bằng tự do tuyển cử chiếu nguyên tắc Dân Tộc Tự Quyết.

 

Tuyên Ngôn Quốc Tế Nhân Quyền minh thị thừa nhận quyền đối kháng trong Phần Mở Đầu: "Điều cốt yếu là nhân quyền phải được một chế độ dân chủ pháp trị bảo vệ để con người khỏi bị dồn vào thế cùng phải đứng lên đối kháng chống áp bức và bạo quyền".

 

Vì con người không phải là á thánh nên xã hội cần phải có chính quyền. Và vì nhà cầm quyền cũng không phải là á thánh nên luật pháp phải dành cho người dân quyền kiểm soát, đối kháng, chế tài và thay thế chính quyền. Nếu không có tự do tư tưởng, tự do thông tin, tự do phát biểu, phê bình và chỉ trích thì không thể có dân chủ. Nếu người dân không được quyền tự do tuyển cử để tham gia chính quyền và thay thế chính quyền thì đảng cầm quyền sẽ hủ hóa thành độc tài, tham nhũng, bất công hay bất lực.

 

Như vậy, tuyên truyền lên án nhà nước độc tài tham nhũng, bất công hay bất lực là những hành vi chính trị  cần thiết trong một chế độ dân chủ pháp trị. Nó không cấu thành tội hình sự như phỉ báng chính quyền hay chống đối nhà nước. Tại các quốc gia dân chủ, tòa án độc lập không kết án những hành vi tuyên truyền cho chủ thuyết cộng sản. Tòa cho đó chỉ là việc hành sử quyền tự do tư tưởng, tự do phát biểu để cổ võ một lý thuyết chủ nghĩa về mặt trừu tượng (abstract doctrine). Chỉ khi nào có sự tổ chức  lật đổ chính quyền bằng tập hợp võ trang, và thực sự có việc khởi sự hành động võ trang gây nguy hiểm rõ rệt và trước mắt cho an ninh quốc gia, thì đương sự mới bị truy tố ra tòa, không phải về tội giả tạo tuyên truyền chống nhà nước, mà về tội phản nghịch.

 

Theo luật pháp phổ thông, người dân có quyền truyền bá các kiến thức nhân quyền cho quảng đại quần chúng. Đồng thời Nhà Nước có trách nhiệm tiên khởi và có nghĩa vụ phải bảo vệ, đề xướng và thực thi nhân quyền và những quyền tự do cơ bản cho tất cả mọi người trong nước được thực sự hưởng dụng những quyền tự do này. Đó cũng là mục tiêu truyền bá nhân quyền và loại trừ hữu hiệu các vi phạm nhân quyền do Liên Hiệp Quốc chủ trương.

 

Do đó, tổ chức các khóa học tập và thảo luận về những vấn đề nhân quyền cho các sinh viên (ở đây là các sinh viên Trường Cao Đẳng về Truyền Thông, Phát Thanh và Truyền Hình), cũng như cho các cộng tác viên (ở đây là các nhân viên Văn Phòng Luật Sư), không cấu thành tội tuyên truyền chống nhà nước.

 

Tại các quốc gia dân chủ lấy Luật Quốc Tế Nhân Quyền làm kim chỉ nam, tòa án không truy tố người dân về những tội tuyên truyền chính trị, dầu là tuyên truyền chống chính phủ, chống chế độ hay chống nhà nước.

 

Vì những lý do nêu trên, nếu Vụ Án Linh Mục Nguyễn Văn Lý và Vụ Án các Luật Sư Nguyễn Văn Đài và Lê Thị Công Nhân được đưa ra trước Ủy Ban Nhân Quyền Liên Hiệp Quốc thì Khối Công Tác về Giam Giữ Độc Đoán sẽ thụ lý. Và khi cuộc điều tra kết thúc, Liên Hiệp Quốc sẽ tuyên Nghị Quyết lên án sự bắt giữ và giam cầm 3 tù nhân lương tâm nói trên là độc đoán.

ANTI-STATE PROPAGANDA: CRIME OR RIGHT?

            Over the past 30 years, Father Nguyen Van Ly has been imprisoned four times altogether:

-        In 1977, he was detained for four months by the Vietnamese Administration for "propaganda against the socialist regime".

 

-        In 1983, he was sentenced by the Court to 10 years in prison for "sabotage of the national unity policy".

 

-        After 9-11, in October 200l, The Vietnamese Communist Party escalated its repression and condemned him to 15 years in prison for "sabotage of the national unity policy" and "violation of the administrative internment decision".

 

-        And on March 30, 2007, he was sentenced to eight years in prison for "propaganda against the Socialist Republic of Vietnam".

 

Six weeks later, on May 11, 2007, Human Rights Lawyers Nguyen Van Dai and Le Thi Cong Nhan were sentenced respectively to five and four years in prison for the same offense.

 

Those are serious crimes of violation of national security with prison terms up to 12 or 20 years.  Yet, the guarantees necessary for the defense were not observed. The Vietnamese Government has adopted the inquisitory system in which the judges act as prosecutors and the proceedings are conducted secretly. In those cases, the investigations and reports have been made without the presence and counseling of independent attorneys. 

 

At the hearing, Father Ly and his four associates could not defend themselves in person or through legal assistance. The hearing was opened at 8AM and the judgement was pronounced at noon after four hours of testimony and deliberation. In the Nguyen Van Dai and Le Thi Cong Nhan case, the accused only had a very short amount of time to prepare for their defense. 

 

 They were notified of their indictments on May 4, 2007 and the sentence was rendered seven days later, on May 11, 2007. This short time frame is a flagrant violation of the right of the defendants to have adequate time and facilities for the preparation of their defense and to communicate with their counsels, pursuant to Article 14 of the International Covenant on Civil and Political Rights (ICCPR).

 

A study of the judiciary history of Vietnam reveals that, in political trials, the courts have tended to hand out predetermined sentences under the directives of the Communist Party.

 

Since the 1990s, the following six political trials:

1)     the verdict of  November 29, 1991 sentencing Doctor Nguyen Dan Que to 20 years in prison for rebellion or having activities aimed to overthrow the people's government;

2)      the verdict of October 19, 2001 sentencing Father Nguyen Van Ly to 15 years for sabotage of the national unity policy and violation of the administrative internment decision;

3)     the verdict of November 8, 2002 handing Lawyer Le Chi Quang a four-year sentence for anti-state propaganda;

4)     the verdict of December 20, 2002 condemning Veteran Nguyen Khac Toan to 12 years for espionage;

5)     the verdict of March 30, 2007 sending Father Ly to prison for eight years for anti-state propaganda; and

6)     the verdict of May 11, 2007 sentencing Attorneys Nguyen Van Dai and Le Thi Cong Nhan  to five and four years, respectively, for the same offense;

 

show striking similarities in that all six cases were judged summarily in just a few hours and on Fridays. The clear intention was to minimize the reaction of the mass media and to divert the attention of the general public in the upcoming weekend.

 

            Propaganda against the regime or propaganda against the state does not constitute a crime.  Propaganda is merely the exercise of the right to freedom of opinion and freedom of expression.  Together with the freedom of association, specifically the right to form opposition parties and independent trade unions, these rights are protected by Articles 19 and 22 of the ICCPR, and by Article 69 of the Vietnamese Constitution.  Therefore, the sentences against Father Ly and associates, and the two Attorneys, have clearly violated the national constitution and the international covenant.

 

            Propaganda against the regime and propaganda against the state are both fictitious crimes nonexistent in the penal codes of civilized nations around the world.

 

            Pursuant to Article 15 of the ICCPR "no one shall be held guilty of any criminal offense on account of any act which did not constitute a criminal offense, under national or international law, [where international law means] the general principles of law recognized by the community of nations".

 

Regarding the crime of propaganda against the regime, in the middle of the 19th century, when Karl Marx issued the Communist Manifesto calling on the proletariat around the world for an armed uprising to overthrow capitalist governments, he was not prosecuted by the Court in London for the crime of propaganda against the capitalist regime.

 

Following the Democratic Revolution in Eastern Europe, in the 1990's, human civilization has thrown off into history the so-called socialist regime.  For this reason, the Vietnamese Communist Party has changed the name of the offense, from propaganda against the regime (former Article 82) to propaganda against the state (new Article 88).

 

            In their indictments, Father Nguyen Van Ly and Lawyers Nguyen Van Dai and Le Thi Cong Nhan were charged with the crime of propaganda against the state pursuant to Article 88, Section 1, Items (a) and (c) of the Penal Code.  They were held responsible for defaming the state, and for slanderous acts against the government through distorted propaganda and the storage and distribution of documents attacking the authorities.

 

            Article 88, Section 1, Item (b) also condemns as anti-state propaganda any political act of "using psychological warfare to spread confusion among the people".  This is an obsolete crime, a vestige of the Cold War.  The Communists consistently confuse the law with politics.  They have invented fictitious non-judiciary crimes, such as being reactionary, anti-revolutionary, wicked landlord, capitalist comprador, anti-party revisionist, anti-communist writer or artist etc.  For them, politics comes first and the law is but a tool.  The Penal Code of 1985 confirms this fact: "In the legal system of the Socialist Republic of Vietnam, the criminal law is a sharp instrument to consolidate the dictatorship of the proletariat and to protect the socialist regime".       

 

            With this frame of mind, they have promulgated penal codes establishing false, fictitious, coercive, and preposterous crimes, with overbroad and vague incriminating elements, such as the crimes of anti-socialist propaganda, anti-state propaganda, abusing the democratic freedoms, sabotaging the policy of national unity, sabotaging the policy of international unity, espionage, rebellion or having activities aimed at overthrowing the government, etc. 

 

            In 1982, Vietnam became a State Party of the ICCPR, and, therefore has a legal obligation to respect, adopt and enforce the provisions stipulated in the Covenant.

 

Pursuant to Article 2 of the Covenant "each State Party to the present Covenant undertakes to respect and to ensure to all individuals within its territory the rights recognized in the present Covenant. Where not already provided for by existing legislative measures, each State Party undertakes to adopt such laws and to give effect to the rights recognized in the present Covenant".

 

 For those States Parties that do not adopt such provisions in their national laws or constitutions, the articles on human rights and fundamental freedoms protected by the Covenant shall have full force and credit in national and international courts.

 

Furthermore, pursuant to Article 5 of the Covenant "nothing in the present Covenant may be interpreted as implying for any State any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized herein."

 

             Political propaganda is not a crime, even if it is propaganda against the government, the regime, or the state.  It is merely the exercise of the freedom of thought and opinion, the freedom of expression, the right to opposition, the right to participate in government, and the right to change the government through free and fair elections according to the Principle of People's Self-Determination, by which "the will of the people shall be the basis of the authority of government". This principle is acknowledged by  Article 21 of the Universal Declaration of Human Rights (UDHR), Article 1 of the United Nations charter, and Article 1 of the ICCPR.

 

            Concerning the right to freedom of peaceful assembly and association, there are no political conspiracies in countries dedicated to political freedom and free expression of ideas and information, how distasteful they may be. The only activities not protected by the ICCPR are political gatherings to incite the violent overthrow of the government by arms.

 

            Because individuals are not saints, society needs a government.  And because those who hold power are not saints, citizens need the right to control, oppose, sanction, and replace the government.  Without the freedom of opinion, the freedom of expression, of discussion and criticism, democracy cannot exist.  If people do not have the right to free election in order to participate in government and to replace the government, then the party in power will become dictatorial, corrupt, unjust, or incompetent.

 

            Therefore, political propaganda to denounce a government that is dictatorial, corrupt, unjust, or incompetent is a necessity in a multi-party democratic system.  Such propaganda is not a crime. It is a right.  In cases where this right is protected by the rule of law, independent courts do not condemn and confiscate communist publications which constitute, in essence, propaganda against the capitalist regime and state.

 

The court considers such activities as the exercise of the freedom of opinion, and the freedom of expression to debate doctrines in the abstract.  Only when there are organized armed movements to overthrow the government, with a beginning of execution that represents a real and present danger to the national security, will the activists be prosecuted, not for the false crime of propaganda against the state, but for rebellion.

 

Together with the right to freedom of opinion and freedom of expression, the right to opposition or the resistance to oppression has been acknowledged in the Preamble of the UDHR: "The disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind. And, it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law."

 

            The Declaration of The Rights of Man and Citizen of 1789 declares: "Men are born and remain free and equal in rights. The aim of every political association is the preservation of the natural and imprescriptible rights of man. These rights are liberty, property, security, and resistance to oppression. The free communication of ideas and opinions is one of the most precious of the rights of man".

 

            The Declaration of Independence of 1776 asserts:

 

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed. That whenever any form of government becomes destructive of these ends, it is the right of the people to alter or to abolish it, and to institute new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness.

 

When a long train of abuses and usurpations evinces a design to reduce [the people] under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security."

 

In its Joint Resolution of May 5, 1994, the Congress of the United States "urges Hanoi to release all political prisoners; to restore all basic human rights, such as freedom of speech, religion, movement, and association; to abolish the single-party system and permit the functioning of all political organizations without intimidation or harassment."

 

For the reasons mentioned above, if the cases of Father Nguyen Van Ly and of Attorneys Nguyen Van Dai and Le Thi Cong Nhan are submitted to the Council for Human Rights at the United Nations, then the Working Group on Arbitray Detention will handle the cases. And at the conclusion of the investigation, The United Nations should hand out a resolution denouncing the detentions of these  prisoners of conscience as arbitrary.
